Terms

The terms outlined below are important, apply to all transactions and are based upon orders which are accepted by the company. They will continue to apply to all transactions going forward unless or until modified by written agreement between us.

Minimum Order Policy:

The minimum order we accept is £1,000 (excluding VAT, duty and delivery)

Trade Sales:

All wines are sold ex-LCB unless otherwise agreed in writing. Further delivery charges, duty and VAT will be charged as appropriate on all shipments. We can recommend a range of suitable freight forwarders for export customers if required.

Prices:

Unless specified, prices on this site are:

Per case (cs) or per bottle (bt) as indicated.
Exclusive of VAT and duty if listed IB.
Exclusive of VAT only if listed DP.
Exclusive of delivery charges
Provisional and subject to our confirmation, upon acceptance of order.

Payment:

Payment is due on receipt of invoice, and must be made by bank transfer. Unless an account facility is held or agreed prior to order. Export orders for Trade Customers must be paid in full prior to release. Overdue sums carry interest from the date when payment becomes due at 5% per annum above the base rate of the Bank of England. We reserve the right to allocate any funds received to any part paid or unpaid invoices as we see fit. Until all overdue payments have been paid, we reserve the right to retain possession of any goods to which you would usually be entitled. If accounts are not settled within the agreed terms, we reserve the right to charge a cancellation fee to cover any losses incurred by us as a result of the client’s failure to meet the payment terms. We also reserve the right to use any monies held on account or to liquidate any stock owned by the client in question and held in our care, to cover any losses incurred by us as a result of the client’s failure to meet the payment terms. If any payment is overdue we shall be entitled to suspend deliveries/collections. Mastercard and Visa credit cards are accepted for payments, however a surcharge may be applicable to some credit card payments.
Invoices will be available online 72 hours after confirmation, subject to registering online.

Title and Risk:

We shall retain the title to all wines until all sums due from the buyer are paid in full.

Non-Collection:

Any wines not collected within one month of release date will be stored at a cost of £9.00 plus VAT per case, per year, with a minimum charge of six months.

Delivery:

All orders are subject to 4-12 week shipping cycles unless agreed with written confirmation. Any communication of when wines are to be made available for delivery or collection is an estimate and is not intended to be binding. We will notify you once wines are available and you must give at least 72 hours’ notice before collection.

Acceptance:

You undertake to inspect all goods when collecting or immediately upon delivery and to notify Crump, Richmond and Shaw or the freight forwarder forthwith of any shortage, damage or other deficiency. It will be assumed that you have accepted the goods as satisfying to your order fourteen days after collection/delivery, and thereafter will not be authorised to reject or return wines for any reason.

Trade clients undertake to inspect all goods when collecting or immediately upon delivery and to notify Crump, Richmond and Shaw or the freight forwarder forthwith of any shortage, damage or other deficiency. It will be assumed that you have accepted the goods as satisfying to your order three days after collection/delivery, and thereafter will not be authorised to reject or return wines for any reason.

Force Majeure:

We shall not be liable for any failure to meet our obligations by circumstances beyond our reasonable control.

Description/Quality

We will make every effort to ensure the proper cellaring of wines and will act in good faith when purchasing wine. All of our suppliers have been informed in writing that capsules and labels should be in excellent condition. We cannot be responsible for the condition of wines or whether they show any attributes which might be expected. We will consider requests for replacing any stock that is sold and is undrinkable at our own discretion.

Jurisdiction:

All contracts are subject to English law and jurisdiction. All wines are offered subject to market movement and remaining unsold.
